Website Terms of Use

These Website Terms of Use (“Agreement”) are a legally binding contract between you and ElastixAI, Inc. (“ElastixAI,” “us,” “we,” or “our”) regarding your use of our website at https://www.elastix.ai/ and our related websites, and the content, forms, chat, demo, playground, and other informational, demonstration, evaluation, or similar functionality made available through them (collectively, the “Website”). References to “Customer,” “you,” and “your” refer to the individual, company, or other entity that accepts the Agreement by accessing or using the Website, clicking an acceptance mechanism, or otherwise affirmatively accepting the Agreement. If the Website is being used on behalf of a company or other entity by an individual authorized to accept this Agreement on its behalf, then all references to “Customer,” “you,” and “your” refer to the company or other entity, and the individual represents and warrants that they have authority to bind that entity. You must be at least thirteen (13) years old to use the Website. If you are under the age of legal majority where you live, you may use the Website only with the permission of a parent or legal guardian. ElastixAI also offers products and services governed by the ElastixAI Terms of Service available at https://elastix.ai/legal/terms (the “Terms of Service”), together with any applicable order form or other agreement that supplements or incorporates the Terms of Service (collectively, the “Services Agreement”), as described in Section 4. For clarity, this Agreement continues to govern your use of the Website even if you also have an ElastixAI account or commercial relationship. If you are not eligible, or do not agree to this Agreement, you do not have our permission to use the Website. Your use of the Website constitutes your agreement to be bound by this Agreement.

1.Defined Terms

Certain capitalized terms used in this Agreement are defined in Section 14 (Definitions) and others are defined contextually in this Agreement.

2.Overview

The Website includes public-facing features and functionality that allow users to access and evaluate AI inference for selected large language models and other AI models (collectively, “Models”), including through chat, demo, playground, limited preview, limited API access, and similar functionality. Products, services, features, or functionality made available through an ElastixAI account, authenticated dashboard, or otherwise under a Services Agreement are governed as described in Section 4. Models may be made available by ElastixAI or third parties and may be subject to applicable third-party license terms. Output is generated through the Models made available through the Website.

3.The Website

3.1Permitted Use

Subject to the terms and conditions of this Agreement, ElastixAI permits Customer and, if Customer is a company or entity, Customer’s Users to access and use the Website solely for informational, demonstration, evaluation, and testing purposes and not for production or other commercial purposes.

3.2Access and Availability

The Website may be made available without account registration or through other access mechanisms, including limited API credentials, and may be subject to rate limits, usage limits, geographic restrictions, technical restrictions, or other access controls imposed by ElastixAI in its discretion. ElastixAI may require an account or other authentication for products, services, features, or functionality outside the Website; any such account-based or authenticated use is governed by an applicable Services Agreement and not this Agreement.

3.3Restrictions

Customer will not (and will not permit its Users or anyone else to) do any of the following: (a) sell, sublicense, rent, distribute, or otherwise commercially exploit the Website or access to it; (b) use the Website on behalf of, or to provide any product or service to, third parties; (c) use the Website to develop a similar or competing product or service; (d) reverse engineer, decompile, disassemble, or seek to access source code underlying, or non-public APIs associated with, the Website, except to the extent expressly permitted by Law (and then only with prior notice to ElastixAI); (e) modify or create derivative works of the Website or copy any element of the Website; (f) remove or obscure any proprietary notices in the Website; (g) publish benchmarks or performance information about the Website; (h) interfere with the operation of the Website, circumvent any access or usage restrictions, rate limits, or other technical controls, access or use the Website through bots, crawlers, scrapers, scripts, or other automated means except as expressly authorized by ElastixAI, or conduct any security or vulnerability test of the Website; (i) transmit any viruses or other harmful materials to the Website; (j) take any action that risks harm to others or to the security, availability, or integrity of the Website; (k) access or use the Website in a manner that violates any Law; or (l) submit personal information (as defined in ElastixAI’s Privacy Policy), other than contact or other information expressly requested by ElastixAI through the Website, or use the Website with Prohibited Data or for High Risk Activities. Customer acknowledges that the Website is not intended to meet any legal obligations for these uses, including HIPAA requirements, and that ElastixAI is not a Business Associate as defined under HIPAA. Notwithstanding anything else in this Agreement, ElastixAI has no liability for Prohibited Data or use of the Website for High Risk Activities. If Customer wishes to evaluate an ElastixAI product or service using personal information or Prohibited Data, Customer must first arrange with ElastixAI for access under an applicable Services Agreement and any additional data-processing terms required by ElastixAI.

3.4Support

ElastixAI may provide Customer with support for the Website in its discretion but has no obligation to do so.

3.5Use of Customer Data

Customer grants ElastixAI the non-exclusive, worldwide, sublicensable right to Process Customer Data solely as necessary to: (a) provide the Website, including to process any Input on the specified Model and return any Output; (b) derive or generate Usage Data; (c) comply with Laws; and (d) as otherwise expressly authorized by Customer. ElastixAI will not use Customer Data to train or fine-tune artificial intelligence or machine learning models for ElastixAI’s or any third party’s benefit unless Customer expressly directs or authorizes that use.

3.6Privacy Policy

ElastixAI will Process Customer Data as necessary to provide the Website, and to the extent personal information as defined in ElastixAI’s Privacy Policy is uploaded, transmitted, submitted, provided, or processed in connection with Customer’s use of the Website, such processing is governed by and subject to the Privacy Policy. ElastixAI will comply with the Privacy Policy.

3.7Usage Data

ElastixAI may Process Usage Data for internal business purposes to: (a) administer the Website and enforce applicable usage and rate limits; (b) provide support for the Website; (c) monitor the performance and stability of the Website; (d) prevent or address technical issues with the Website; (e) improve the Website and ElastixAI’s other products and services and develop new products and services; and (f) conduct other lawful business activities, such as analytics, benchmarking, and reporting. Customer will not interfere with the collection of Usage Data.

3.8Customer Obligations

Customer is responsible for its Customer Data, including its content and accuracy, and will comply with Laws and the Acceptable Use Policy when using the Website. Customer represents and warrants that it has made all disclosures, provided all notices, and has obtained all rights, consents, and permissions necessary for ElastixAI to collect, access, use, disclose, transfer, transmit, store, host, or otherwise process the Customer Data set forth in this Agreement without violating or infringing Laws, third-party rights, or terms or policies that apply to the Customer Data.

3.9Suspension

ElastixAI may immediately suspend, limit, or block Customer’s or its Users’ access to the Website if: (a) Customer breaches Section 3.3 (Restrictions) or Section 3.8 (Customer Obligations); (b) Customer exceeds or circumvents applicable rate limits or access restrictions; (c) changes to Laws or new Laws require suspension or otherwise may impose additional liability on ElastixAI; (d) Customer’s or its Users’ actions risk harm to others or to the security, availability, or integrity of the Website; or (e) ElastixAI otherwise determines that suspension or limitation is reasonably necessary to protect the Website, ElastixAI, or others. ElastixAI may take these actions with or without notice and without liability to Customer.

3.10Modifications to the Website

ElastixAI may modify or discontinue all or any part of the Website at any time (including by limiting or discontinuing certain features or functionality of the Website, or adding or removing any Models), temporarily or permanently, without notifying Customer. ElastixAI will have no liability for any change or modification to the Website or any suspension or termination of access to or use of the Website as a result thereof.

3.11Technical Requirements

Customer is responsible for providing and maintaining the devices, software, Internet access, and other systems necessary to access and use the Website.

3.12Third-Party Technology

Third-Party Technology may be made available or used in connection with the Website and may be subject to Customer’s agreements with the relevant provider. ElastixAI does not control and has no liability for Third-Party Technology, including its security, functionality, operation, availability, interoperability with the Website, or applicable third-party terms. To the extent Customer directs the Website to interact with Third-Party Technology, Customer authorizes ElastixAI to access and exchange Customer Data with that Third-Party Technology as necessary to provide the requested functionality. The Website may contain links to third-party websites, services, or resources. ElastixAI provides those links for convenience only and does not control or endorse, and is not responsible for, any third-party website, service, resource, content, product, or practice. Customer accesses and uses third-party websites, services, and resources at Customer’s own risk and subject to any terms and policies applicable to them.

4.Commercial Products and Services

4.1Services Agreement

Products, services, features, or functionality made available through an ElastixAI account or authenticated dashboard are governed by an applicable Services Agreement. API access or other evaluation functionality may be made available under this Agreement, a Services Agreement, or both, depending on how access is provided. If any access or functionality is subject to both this Agreement and a Services Agreement, the Services Agreement controls to the extent of any conflict. For clarity, this Agreement continues to govern Customer’s use of the Website, including public-facing inference and evaluation functionality, even if Customer also has an ElastixAI account or commercial relationship.

5.Warranties and Disclaimers

5.1No Warranty

No warranty applies to the Website under this Agreement.

5.2Customer Warranty

Customer warrants to ElastixAI that: (a) it has all rights, licenses, permissions, power, and authority necessary to use and share the applicable Inputs in connection with the Website; (b) it has all rights, licenses, permissions, power, and authority necessary to access and use the Models; (c) it will use the Models and any Output in compliance with Laws; (d) neither Customer Data nor Customer’s use, storage, or provision of Customer Data will infringe, misappropriate, or violate any third party’s intellectual property, privacy, publicity, confidentiality, or other rights, or any applicable third-party terms; and (e) Customer’s use and provision of Customer Data will not breach any agreement between Customer and a third party or violate any Laws.

5.3Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL MODELS, OUTPUTS, CONTENT, AND MATERIALS MADE AVAILABLE THROUGH THE WEBSITE ARE PROVIDED “AS IS.” ELASTIXAI, ON ITS OWN BEHALF AND ON BEHALF OF ITS SUPPLIERS AND LICENSORS, MAKES NO OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NONINFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE, MODELS, OUTPUTS, CONTENT, OR MATERIALS WILL BE UNINTERRUPTED, FREE OF HARMFUL CODE, ACCORDING TO EXPECTATIONS, OR ERROR-FREE, THAT ELASTIXAI WILL REVIEW CUSTOMER DATA FOR ACCURACY, THAT IT WILL MAINTAIN CUSTOMER DATA WITHOUT LOSS, OR THAT ANY ISSUES WILL BE CORRECTED.

ELASTIXAI HAS NO CONTROL OVER, AND ASSUMES NO RESPONSIBILITY FOR, THIRD-PARTY TECHNOLOGY, INCLUDING ANY OUTPUT FROM MODELS. THIRD-PARTY TECHNOLOGY MAY NOT BE WARRANTED IN ANY MANNER BY THE APPLICABLE THIRD PARTIES, AND THE DEVELOPMENT OF THIRD-PARTY TECHNOLOGY MAY HAVE INFRINGED THE RIGHTS OF OTHERS OR USED MATERIALS SUBJECT TO COPYRIGHT WITHOUT EXPRESS CONSENT FROM THE COPYRIGHT HOLDERS IN JURISDICTIONS WHERE SUCH CONSENT WAS REQUIRED. ELASTIXAI DOES NOT WARRANT THAT ANY THIRD-PARTY TECHNOLOGY COMPLIES WITH LAWS. ELASTIXAI ENCOURAGES CUSTOMER TO DETERMINE, INCLUDING THROUGH HUMAN REVIEW IF NECESSARY, WHETHER OUTPUT GENERATED BY A MODEL IS SUBJECT TO THIRD-PARTY COPYRIGHT OR OTHER RIGHTS.

ELASTIXAI DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY OUTPUT, INFORMATION, OR RECOMMENDATION PROVIDED THROUGH THE MODELS. CUSTOMER WILL NOT RELY ON THE OUTPUT OR ANY RECOMMENDATION AS A SUBSTITUTE FOR ITS OWN INDEPENDENT DETERMINATIONS AND IS RESPONSIBLE FOR ANY ACTS OR OMISSIONS CUSTOMER UNDERTAKES BASED ON RECOMMENDATIONS, OUTPUTS, AND OTHER INFORMATION CUSTOMER RECEIVES FROM THE MODELS. THE OUTPUT IS POWERED BY ARTIFICIAL INTELLIGENCE AND CUSTOMER ACKNOWLEDGES AND AGREES THAT ARTIFICIAL INTELLIGENCE TOOLS ARE NOVEL AND EXPERIMENTAL, AND THAT THEREFORE THERE IS SIGNIFICANT UNCERTAINTY REGARDING THE OPERATION OF SUCH TOOLS. MODELS MAY RETURN INACCURATE OUTPUT THAT DOES NOT ACCURATELY REFLECT REAL PEOPLE, PLACES, OR FACTS. THE MODELS DO NOT AND ARE NOT INTENDED TO PROVIDE ANY SAFETY, LEGAL, FINANCIAL, TAX, ACCOUNTING, OR OTHER PROFESSIONAL ADVICE. THE MODELS ARE CAPABLE OF GENERATING SOME OUTPUT THAT MAY BE INAPPROPRIATE, OFFENSIVE, ILLEGAL IN CERTAIN JURISDICTIONS, SUGGESTIVE, PORNOGRAPHIC, LASCIVIOUS, VIOLENT, GRAPHIC, OR RELATED TO FETISHES AND/OR NOT SUITABLE FOR CHILDREN. ELASTIXAI DOES NOT CONDONE OR IN ANY WAY ENCOURAGE SUCH OUTPUT CREATION. PRIOR TO ANY USE OF THE WEBSITE, CUSTOMER AND ITS USERS WILL MAKE THEIR OWN DETERMINATIONS AS TO THE EFFICACY, ACCURACY, LAWFULNESS, AND APPROPRIATENESS OF THE MODELS OR ANY OUTPUT FOR ANY GIVEN USE. CUSTOMER IS SOLELY RESPONSIBLE FOR MONITORING THE PERFORMANCE OF THE MODELS AND CUSTOMER IS ULTIMATELY RESPONSIBLE FOR ITS USE OF THE WEBSITE, MODELS, OR OUTPUT TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS. THE PARTIES FURTHER ACKNOWLEDGE THAT AREAS OF LAW WHICH APPLY TO THE MODELS ARE EVOLVING RAPIDLY IN VARIOUS JURISDICTIONS. ELASTIXAI’S COMPLIANCE WITH LAWS IN ONE JURISDICTION MAY NOT NECESSARILY RESULT IN COMPLIANCE IN ALL JURISDICTIONS.

ELASTIXAI IS NOT LIABLE FOR DELAYS, FAILURES, OR PROBLEMS INHERENT IN USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS OR OTHER SYSTEMS OUTSIDE ELASTIXAI’S CONTROL. CUSTOMER MAY HAVE OTHER STATUTORY RIGHTS, BUT ANY STATUTORILY REQUIRED WARRANTIES WILL BE LIMITED TO PERFORMANCE TO THE SHORTEST LEGALLY PERMITTED PERIOD.

6.Term and Termination

6.1Term

This Agreement begins when Customer first accesses or uses the Website and continues for so long as Customer accesses or uses the Website, unless terminated earlier under this Section 6.

6.2Termination by Customer

Customer may terminate this Agreement at any time by ceasing all use of the Website.

6.3Suspension or Termination by ElastixAI

If Customer violates any provision of this Agreement, Customer’s authorization to access or use the Website automatically terminates. In addition, ElastixAI may suspend or limit Customer’s access to the Website or terminate this Agreement at any time for any reason or no reason, with or without notice, and without liability to Customer.

6.4Effect of Termination

Upon expiration or termination of this Agreement, Customer must cease use of the Website. ElastixAI may retain or delete Customer Data only as permitted by the Privacy Policy and applicable Law.

6.5Survival

These Sections survive expiration or termination of this Agreement: 3.3 (Restrictions), 3.5 (Use of Customer Data), 3.7 (Usage Data), 3.8 (Customer Obligations), 5.3 (Disclaimers), 6.4 (Effect of Termination), 6.5 (Survival), 7 (Ownership), 8 (Limitations of Liability), 9 (Indemnification), 10 (No Confidentiality), 13.1 (General Provisions), 13.2 (Governing Law), 13.3 (Additional Terms), and 14 (Definitions). Except where an exclusive remedy is provided in this Agreement, exercising a remedy under this Agreement, including termination, does not limit other remedies a party may have.

7.Ownership

Neither party grants the other any rights or licenses not expressly set out in this Agreement. Except as expressly provided in this Agreement, as between the parties, Customer retains all intellectual property rights and other rights in Customer Data. Except for Customer’s use rights in this Agreement, ElastixAI and its licensors retain all intellectual property rights and other rights in the Website, Software, Documentation, Usage Data, and ElastixAI’s technology, templates, formats, and dashboards, including any modifications or improvements to these items made by us. If Customer provides ElastixAI with feedback or suggestions regarding the Website or its other offerings, ElastixAI may use the feedback or suggestions without restriction or obligation. To the extent ElastixAI has any rights in Output, ElastixAI grants Customer a non-exclusive, royalty-free right to use the Output solely for evaluation and testing purposes, subject to any third-party terms that may apply to such Output. Customer may not use Output for production or commercial purposes under this Agreement.

8.Limitations of Liability

Except for Customer’s breaches of Sections 3.1 (Permitted Use) and 3.3 (Restrictions), neither ElastixAI nor Customer nor their respective suppliers or licensors will have liability arising out of or related to this Agreement for any loss of use, lost data, lost profits, failure of security mechanisms, interruption of business, or any indirect, special, incidental, reliance, or consequential damages of any kind, even if informed of their possibility in advance. Except for Customer’s breaches of Sections 3.1 (Permitted Use) and 3.3 (Restrictions) and Customer’s obligations under Section 9 (Indemnification), the aggregate liability of ElastixAI, Customer, and their respective suppliers and licensors arising out of or related to this Agreement will not exceed $100. The waivers and limitations in this Section 8 apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and will survive and apply even if any limited remedy in this Agreement fails of its essential purpose.

9.Indemnification

Customer will defend ElastixAI from and against any third-party claim to the extent resulting from Customer Data or Customer’s breach or alleged breach of Section 3.8 (Customer Obligations) or Section 5.2 (Customer Warranty) and will indemnify and hold ElastixAI harmless against any damages and costs awarded against ElastixAI (including reasonable attorneys’ fees) or agreed in a settlement by Customer resulting from the claim.

10.No Confidentiality

The Website includes public-facing evaluation functionality. Customer will not submit or disclose through the Website any information that Customer considers confidential or proprietary. Except for obligations concerning personal information expressly set forth in the Privacy Policy and obligations imposed by applicable Law, ElastixAI has no contractual confidentiality obligation under this Agreement with respect to Customer Data or other information submitted through the Website.

11.Evaluation and Pre-Release Features

The Website includes free, limited public-facing evaluation functionality, including chat, demo, playground, inference, preview, and similar interactive functionality. ElastixAI may also designate features or functionality as alpha, beta, preview, early access, experimental, or similar (together, “Evaluation and Pre-Release Features”). Evaluation and Pre-Release Features are part of the Website and are made available solely for evaluation and testing and not for production or other commercial purposes. They may be subject to rate or usage limits, may be modified, suspended, or discontinued at any time, and may be inoperable, incomplete, contain errors, or include functionality that ElastixAI may never release generally. Customer’s and its Users’ use of Evaluation and Pre-Release Features is at their own risk. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT, ELASTIXAI PROVIDES NO WARRANTY, INDEMNITY, OR SUPPORT FOR EVALUATION AND PRE-RELEASE FEATURES.

12.Modifications

ElastixAI may modify this Agreement from time to time by posting a revised version on its website or otherwise making it available through the Website. Unless ElastixAI states otherwise, modifications are effective when posted. It is Customer’s responsibility to review this Agreement periodically. By continuing to access or use the Website after revised terms become effective, Customer agrees to be bound by the revised terms. If Customer does not agree to the revised terms, Customer must stop using the Website.

13.Miscellaneous

13.1General Provisions

This Agreement, including the Privacy Policy and any other agreements expressly incorporated by reference into this Agreement, is the entire and exclusive understanding and agreement between Customer and ElastixAI regarding Customer’s use of the Website under this Agreement, but does not supersede or modify any Services Agreement applicable to account-based products or services. Customer may not assign or transfer this Agreement or Customer’s rights under this Agreement, in whole or in part, by operation of law or otherwise, without ElastixAI’s prior written consent. ElastixAI may assign this Agreement and all rights granted under this Agreement at any time without notice or consent. The failure to require performance of any provision will not affect ElastixAI’s right to require performance at any other time after that, nor will a waiver by ElastixAI of any breach or default of this Agreement, or any provision of this Agreement, be a waiver of any subsequent breach or default or a waiver of the provision itself. Use of Section headers in this Agreement is for convenience only and will not affect the interpretation of any provision. Neither party is liable for any delay or failure to perform any obligation under this Agreement due to events beyond its reasonable control, such as a strike, pandemic, epidemic, health emergency, blockade, war, act of terrorism, riot, Internet or utility failure, refusal of government license, or natural disaster. Throughout this Agreement, “including” means “including but not limited to.” If any part of this Agreement is held invalid or unenforceable, that part will be given effect to the greatest extent possible, and the remaining parts will remain in full force and effect.

13.2Governing Law

This Agreement is governed by the laws of the State of Washington and the United States without regard to conflicts of laws provisions that would result in the application of the laws of another jurisdiction and without regard to the United Nations Convention on the International Sale of Goods. The jurisdiction and venue for actions related to this Agreement will be the state and United States federal courts located in Washington and both parties submit to the personal jurisdiction of those courts.

13.3Additional Terms

Customer’s use of the Website is subject to all additional terms, policies, rules, or guidelines applicable to the Website or certain features of the Website that ElastixAI may post on or link to from the Website (“Additional Terms”). All Additional Terms are incorporated by this reference into, and made a part of, this Agreement.

13.4Consent to Electronic Communications

By using the Website, Customer consents to receiving certain electronic communications from ElastixAI as further described in ElastixAI’s Privacy Policy. Please read ElastixAI’s Privacy Policy to learn more about ElastixAI electronic communications practices. Customer agrees that any notices, agreements, disclosures, or other communications that ElastixAI sends to Customer electronically will satisfy any legal communication requirements, including that those communications be in writing.

13.5Contact Information

13.6Notice to California Residents

If Customer is a California resident, then under California Civil Code Section 1789.3, Customer may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite S-202, Sacramento, California 95834, or by telephone at +1-800-952-5210 in order to resolve a complaint regarding the Website or to receive further information regarding use of the Website.

14.Definitions

“Acceptable Use Policy”: means the then-current version of ElastixAI’s Acceptable Use Policy, which is available here or such other URL or location as may be specified by ElastixAI from time to time.
“Customer Data”: means any data, content, information, or materials, including Inputs, submitted or otherwise made available by or for Customer through the Website, together with Outputs generated from those Inputs. Customer Data does not include Usage Data.
“Documentation”: means the then-current version of ElastixAI’s usage guidelines and technical documentation for the Website that ElastixAI makes generally available, the current version of which is available here.
“High Risk Activities”: means activities where use or failure of the Website could lead to death, personal injury, or environmental damage, including life support systems, emergency services, nuclear facilities, autonomous vehicles, or air traffic control.
“Inputs”: means content uploaded to or otherwise submitted for Processing through the Website.
“Laws”: means all applicable local, state, federal, and international laws, regulations, rules, and conventions, including those related to data privacy and data transfer, international communications, and export of data.
“Output”: means content generated through the Models based on Customer’s Inputs.
“Privacy Policy”: means the Privacy Policy.
“Process”: means to collect, access, use, disclose, transfer, transmit, store, host, or otherwise process.
“Prohibited Data”: means any: (a) special categories of data enumerated in European Union Regulation 2016/679, Article 9(1) or any successor legislation; (b) patient, medical, or other protected health information regulated by the Health Insurance Portability and Accountability Act (as amended and supplemented) (“HIPAA”); (c) credit, debit, or other payment card data subject to the Payment Card Industry Data Security Standards; (d) other information subject to regulation or protection under specific Laws such as the Children’s Online Privacy Protection Act or Gramm-Leach-Bliley Act (or related rules or regulations); (e) social security numbers, driver’s license numbers, or other government ID numbers; or (f) any data similar to the above protected Laws.
“Software”: means any software, scripts, or other code required by ElastixAI to operate the Website.
“Term”: means the period during which this Agreement remains in effect as described in Section 6.1.
“Third-Party Technology”: means any third-party platform, add-on, service, or product not provided by ElastixAI that Customer elects to access through or integrate or enable for use with the Website including, for the avoidance of doubt, any Models.
“Usage Data”: means technical, operational, and usage information generated from use of the Website, such as model selection, request or token quantities, latency, performance, error, diagnostic, security, rate-limit, and feature-use information, but excluding the contents or substance of Customer Data and information that identifies Customer, Users, or other natural persons.
“User”: means any employee or contractor of Customer that Customer allows to use the Website on Customer’s behalf.
